Freedom to Operate Search


A freedom to operate search or Patent clearance search is done to ascertain whether a proposed technology/product is infringing any in-force patent or not. FTO search can be done jurisdiction wise or it can be performed worldwide depending upon the requirement of the client. If the technology/product does not infringe, then the technology/product can be safely harbored and if it infringes upon some existing patent then the client can take appropriate business decisions like he can modify his product to avert the infringement or he can consider licensing technology/product in issue. The objective of such types of search is to identify patent(s) or patent applications in a country the claims of which would cover the product or process proposed to be commercially exploited. Using various search methodologies blocking patents are identified and claim analysis is performed by subject experts and FTO report is prepared and presented to the client.
